Appellant originally filed with PTAB on 4-7-10. This filing included a 2009 Residential Appeal form in triplicate with a notation that an appraisal would follow. Evidence was not included with the filing and the appellant’s assessment request was not completed. A cover sheet indicates that a 90-day extension of time is requested. PTAB granted the 90-day extension and it expired on 4-25-11 with no evidence and/or correspondence being received from Appellant. PTAB dismissed the appeal on 9-19-11 for insufficient evidence. Appellant has requested PTAB reinstate the appeal per request dated, 9-26-11. Request states that an agreement was made between the BOR and the Appellant for the 2010 tax assessment and the BOR agreed to a stipulated resolution in the 2009 PTAB case. Request further states that a fully executed stipulation resolving the 2009 case was delivered to the Lake County assessment officials on 1-27-11 and that a day or two later PTAB’s extension letter was received with a due date of 4-25-11 for the submission of evidence. Appellant believed the case to be settled and was aware of the backlog at PTAB in processing stipulations. Appellant acknowledges that evidence was not submitted to PTAB but that the dismissal was surprising because it had been settled with the county 9-months earlier. Request states that County officials have no objection to the case being reinstated and to allow the matter to be resolved pursuant to the stipulation previously filed by the parties. A copy of the signed stipulation has been provided and is dated 1-26-11.

In each of the above listed appeals, a PTAB decision dated 1-20-12 was mailed to the above listed Appellants and the file closed on same date. Pursuant to §1910.50(d) of the PTAB’s rules, Appellant, through counsel, is requesting the decisions be reconsidered due to the fact that a material error of law has occurred. Request states that PTAB issued each decision based on Section 16-185 of the Property Tax Code thereby, treating the 2009 case as a “rollover” case rather than the newly initiated overvaluation case that it is. The Appellant’s argued that the PTAB did not consider the fact that the Cook County Ordinance Level of Assessments was reduced in tax year 2009.
Request to Reconsider was filed based on Section 1910.50(d) of the rules of the Property Tax Appeal Board. This section provides in part that the Board may correct and issue an amended decision on its own initiative if there is a mistake in the calculation or other clerical error. The PTAB’s rules do not provide for the reconsideration of a decision or the merits once issued by the Board. The correct procedure would be for each Appellant to file a complaint for Administrative Review. Once the complaint for administrative review has been filed the PTAB could take a voluntary remand to issue a revised decision.
The Appellant appears to have a good argument in that the PTAB erred in applying Section 16-185 of the Property Tax Code under the facts of these appeals.
