HEART DEFIBRILLATORS
DPH also proposed amendments
to "Heartsaver AED Grant Code"
(77 Ill Adm Code 530; 35 Ill Reg
11197) concerning grants awarded
for the purchase of automated heart
defibrillators (AEDs). An amend-ment
specifies that the recipient
must place the AED into public
service within 8 weeks after receipt
of grant funds and complete re-quired
documentation. Also, the
address of DPH's Division of Emer-gency
Medical Systems and High-way
Safety in Springfield is up-dated.
Those affected by this
rulemaking include both private
and public educational entities,
forest preserves and conservation
districts, and municipal recreation
departments.

CEMETERY OVERSIGHT
The DEPARTMENT OF FINANCIAL
AND PROFESSIONAL REGULA-TION
proposed a new Part titled
"Cemetery Oversight Act" (68 Ill
Adm Code 1249; 35 Ill Reg 11050)
implementing Public Act 96-863,
which authorizes DFPR to regulate
cemeteries in the State of Illinois.
The rules contain general provi-sions
such as definitions of terms
used throughout the Part, appli-cable
licensure and registration fees,
license renewal provisions, inactive
status procedures, lapsed or inac-tive
license restoration, and proce-dures
for granting variances. DFPR
also specifies procedures for main-taining
cemetery records and es-tablishes
a cemetery oversight da-tabase.
The rules, mirroring the Act,
create 3 tiers of cemetery licensure
and registration (fully exempt, par-tially
exempt, and fully operating
cemeteries). Cemetery owners seek-ing
partial or full exemption from
licensure as a cemetery authority
must submit an application with the
appropriate fee. Nonexempt cem-etery
authorities must submit an
application for licensure and pay a
fee commensurate with the number
of interments, inurnments, and en-tombments
at the cemetery in the
previous calendar year. The rules
provide procedures for licensing
newly organized cemetery authori-ties
and licensing multiple locations
under control of the same cemetery
authority. Cemetery authorities that
maintain care funds are required to
provide care fund security in the
form of a fidelity bond, proof of self-insurance,
or letter of credit in an
amount equal to at least 10% of the
value of the care funds. Additional
provisions address changes of cem-etery
ownership, cemetery associa-tion
trustee vacancies, cemetery
authority trust funds, sufficient fi-nancial
resources, cemetery sign-age,
and consumer brochures. Cem-etery
managers and customer ser-vice
employees are also required to
be licensed, pay a licensure fee,
and complete continuing education
requirements. Also, cemetery work-ers,
including independent con-tractors,
must each complete a
"worker's statement" and receive a
DFPR-issued identification card.
The Part also contains a code of
professional conduct and ethics,
care and maintenance standards,
requirements for cemetery maps
and plats, and enforcement and
disciplinary proceedings affecting
cemetery authorities and licensed
employees. Small businesses,
small municipalities, and not-for-profit
corporations that operate
cemeteries may be affected by
these rules.

MEDICARE SUPPLEMENTS

AND FAMILY SERVICES pro-posed
amendments to "Rights and
Responsibilities" (89 Ill Adm Code
102; 35 Ill Reg 11094), "Applica-tion
Process" (89 Ill Adm Code
110; 35 Ill Reg 11101), and "Medi-cal
Assistance Programs" (89 Ill
Adm Code 120; 35 Ill Reg 11108)
concerning Medicare cost sharing
programs for recipients of medical
assistance. The amendments
implement the federal Medicare Im-provements
for Patients and Pro-viders
Act of 2008 (MIPPA), which
simplifies the application process
and expands eligibility for the Medi-care
Savings Program (MSP) and
under which Medicaid pays for all
